hurricane letter
On September 26, 2008, an attorney in a lawsuit, who represented a co-defendant that was adverse to Markland Hanley’s client, sent Markland Hanley partner Dale Markland a letter regarding sewage problems in his yard arising from a hurricane that had recently gone through the Houston, Texas area. The letter was posted on the Internet and received wide distribution.
The letter implied that Mr. Markland had been uncooperative in rescheduling a deposition and stated that Mr. Markland had failed to live up to an agreement that the letter writing attorney purportedly had with Mr. Markland. That implication and that statement are totally inaccurate. Mr. Markland assisted in resetting the deposition, was in no way uncooperative with counsel in the case, never had any agreement with the adverse attorney, and never breached any agreement.
